Terms of Service

These Terms govern your access to and use of InstaSeer, available at instaseer.com and related services.

By using InstaSeer, you agree to these Terms. If you do not agree, do not use the Service. InstaSeer is not affiliated with, endorsed by, or sponsored by Instagram, TikTok, Facebook, or Meta.

1. What InstaSeer Does

InstaSeer is a public social research tool. It helps users search, organize, compare, and export information from visible public social profiles, posts, and reels.

InstaSeer works with visible public posts. It does not access private accounts, private metrics, reach, saves, demographics, ad spend, conversions, or official platform analytics. Reports show what was loaded and keep source links attached so users can verify the evidence.

The Service may include public profile search, sample reports, post and reel list generation, posting timelines, engagement summaries, compare workflows, CSV export, saved views or filters, account plans, and usage limits.

2. Eligibility

You must be at least 13 years old to use InstaSeer. If you use InstaSeer for a business or organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts

Some features require an account. You agree to provide accurate account information, keep your password secure, and notify us if you believe your account has been compromised. You are responsible for activity under your account.

4. Acceptable Use

You may use InstaSeer only for lawful, legitimate research and business purposes.

  • Do not use the Service to harass, stalk, threaten, dox, exploit, or target individuals.
  • Do not use the Service to violate privacy, publicity, intellectual property, platform, or other legal rights.
  • Do not use the Service to build unlawful surveillance, profiling, or discrimination systems.
  • Do not attempt to access non-public Instagram data or bypass access controls.
  • Do not submit Instagram login credentials to InstaSeer.
  • Do not reverse engineer, scrape, overload, attack, or disrupt the Service.
  • Do not circumvent rate limits, plan limits, security checks, or billing controls.
  • Do not resell, sublicense, or provide bulk access to the Service without written permission.
  • Do not use automated systems to abuse free preview limits or avoid paid usage.

We may suspend or terminate access if we believe use of the Service creates legal, security, operational, reputational, or abuse risk.

5. Public Data and Third-Party Providers

InstaSeer works with public web data and third-party providers. Public content can change, disappear, be incomplete, be unavailable, or be returned differently over time.

InstaSeer does not guarantee complete account history, availability of any profile or field, accuracy of third-party data, continuous provider availability, or that every search will return results. Failed provider searches do not consume paid credits.

Reports are best-effort outputs based on available public data, provider behavior, plan limits, and cache state.

6. Plans, Limits, Credits, and Cache

Plans can include limits such as searches per day, provider credits per month, maximum posts or reels per search, CSV export availability, saved views, and compare features.

Provider credits measure paid provider usage. A fresh provider search may consume credits. Cached reports and sample reports may use no credits.

Plan limits and features may change over time. If we make material changes to paid plan features, we will try to provide reasonable notice.

7. Billing and Subscriptions

Paid plans are billed through Stripe. By starting a paid subscription, you authorize Stripe to charge your payment method on a recurring basis according to the plan you select.

Subscriptions renew automatically until cancelled. You can manage or cancel billing through the in-app billing portal or the Stripe customer portal. InstaSeer does not store full credit card numbers.

8. Cancellation

You may cancel a subscription at any time. Unless otherwise stated, cancellation stops future renewals. You may retain access to paid features until the end of the current paid billing period.

Deleting your account or stopping use of the Service does not automatically cancel a subscription unless the billing subscription is also cancelled.

9. Refunds

Refunds are governed by the InstaSeer Refund Policy. The Refund Policy is incorporated into these Terms.

10. User Content and Exports

You are responsible for how you use reports, exports, saved views, and any data generated through InstaSeer. You agree not to present InstaSeer outputs as guaranteed complete, official platform records, or endorsed by Instagram, TikTok, Facebook, or Meta. Review source links before using recommendations in a client or executive report.

11. Intellectual Property

InstaSeer, including its software, interface, branding, design, workflows, and documentation, is owned by us or our licensors. These Terms do not transfer ownership of InstaSeer to you.

12. Feedback

If you send ideas, suggestions, or feedback, you allow us to use them without restriction or compensation.

13. Service Changes and Availability

We may update, change, suspend, or discontinue parts of the Service at any time. We may also impose limits to protect reliability, control provider costs, prevent abuse, or comply with law.

14. Disclaimers

The Service is provided as is and as available without warranties of any kind, whether express, implied, or statutory. You are responsible for determining whether InstaSeer is suitable for your use case.

15. Limitation of Liability

To the maximum extent allowed by law, InstaSeer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or provider failure.

To the maximum extent allowed by law, our total liability for any claim related to the Service will not exceed the amount you paid to InstaSeer in the three months before the claim, or USD $100 if you did not pay us.

16. Indemnity

You agree to defend, indemnify, and hold harmless InstaSeer from claims, damages, liabilities, losses, costs, and expenses arising from your use of the Service, your exports or reports, your violation of these Terms, or your violation of law or third-party rights.

17. Termination

We may suspend or terminate your access to the Service if you violate these Terms, create risk, fail to pay, misuse the Service, or if we need to comply with law.

18. Governing Law

These Terms are governed by the laws of Bangkok, Thailand, without regard to conflict of law rules. Any disputes will be resolved in the courts located in Bangkok, Bangkok, Thailand, unless applicable law requires otherwise.

19. Changes to These Terms

We may update these Terms from time to time. The Last updated date will show when they were last changed. Continued use of InstaSeer after changes means you accept the updated Terms.
